Myspace Issue: Imposter profile.

I work in a retail stores and I came across what seemed to be a profile that one of my co-workers/friends had. It didn't have much, it looked like someone started the profile and didn't finish. It had her name, age and where she lived. I saw her a few days later and told her about the profile and she said that she did not make it. She is pretty upset that someone set up a fake account to try to pretend to be her. She asked me to help in removing it. I tried contacting Customer Service about 5 times and have not recieved a reponse and the profile is still up. I contacted the owner of Myspace, Tom, and he isn't doing anything about the profile that isn't hers. This is a safety issue and we would like this matter resolved as soon as possible. I have just been told that a profile has been made under the name of my son 'Philip Halloran'. This was done by an imposter. There was even a picture of my son on the profile. We as a family are very upset by this as the content was very disturbing. I want everyone to know that this profile was not set up by my son, he only found out about it after one of his friends saw it. The person who set it up is called Martin Farrel. He obviously thinks this was funny. I hope that he reads this and realises the upset he has caused to a lot of people. I dont know much about this site and would like to know how i can get this message published to the home page of bebo so that people will know that it wasnt philip who made this profile.

Julia, I'm glad you heard back from MySpace. To answer your first question, no, unfortunately, there's no assurance that another harassing profile won't just pop up in the place of the deleted one - on MySpace or some other social site you don't even know of. This, unfortunately, is the nature of the user-driven Web, the new "wild west" for lack of a better cliche. As for legal action, the responsible sites like those who support this forum and many others, all honor and act quickly on subpoenas from law enforcement requiring the identity of a bully or predator, but the law prohibits them from sharing a user's identity with another user.

I'm no lawyer, but the only legal action that can be taken against an online imposter or harasser that I'm aware of is the kind people can take about offline stalkers, bullies, etc. - getting a restraining order. This is just another medium for these people, unfortunately. But I doubt a class action suit against any single site or even group of sites would have much of a chance, given existing US law (I don't know about other countries), which courts have interpreted as saying that social sites are like ISPs (or phone companies), not liable for the actions or behaviors of users on their networks. And they also have to protect user privacy and uphold free-speech rights (which "bad people" as well as "good people" enjoy in many countries, for good or bad). That probably doesn't completely answer your question, but there are other people here who could ably fill in the gaps. Thanks for posting,

Yes Anne, thank you so much for your prompt response. I just received an email from myspace notifying me that the profile is scheduled to be deleted, but there's no assurance that this person won't make more attempts to humiliate me again. Is there any other actions I can take or just go through this same process all over again every time the imposter does this?

I would be interested in hearing about legal actions we can take against these imposters as well, because they cross the boundary and go way too far with it. Who knows if they will go further to prove their point by doing other forms of harm ie physical, mental, possessions. Thanks again.

This is outrageous!

I posted earlier about talking to my lawyer about a class-action against myspace and other social websites.

Please go to that thread and give me your feedbacks.

I would like to go after the person who made the profile, but that's not easy to prove. How easy is to serve and win against the impersonator if you know who it is?

They assume that they're safe, that's why they do it. If we fight back, they'll know they're not safe.

Yes, I'm extremely upset. To coward of hiding behind a screen. What kind of man (or woman) do that? Cowards need to be served!

Hi Anne, I'm going through the same issue right now and I've contacted myspace a few times, but no response yet. This imposter profile is on the verge of breaking up my marriage. Oh no, I understand that completely. I will refer this website and use this as a resource in the future. I have learned so much from this experience and how to present myself online. You could say that I was ignorent about what information to share, and what information to keep private for the simple fact is I thought only my friends would be interested in seeing my profile in the first place! This is a great website, I'm really glad I ran into this during my sitation.

You are very welcome, though actually our real purpose is to educate and support discussion about safety on the social Web, not get profiles deleted. But if we can help, it's icing. But if you'd like to share anything you've discovered from this process, that would be most welcome! It is kind of scary, isn't it, that really persistent bullies, harassers, and cyberstalkers can put up new profiles about as fast as (or faster than) they can be taken down? Good luck going forward,

I just received an automated e-mail from MySpace saying that they could not understand my request. I have sent them four seperate salutes, a detailed description of what is going on with the imposter profile, a direct link to the profile, along with a picture of myself holding up a sign that reads, 'MySpace.com - and my e-mail address'. This has been going on for a week, I would really appreciate it someone could perhaps e-mail MySpace with regards of what is going on here. I would be a little more patient if it just had a picture of me with the cruel remarks, but this page displays my address, which is why I want this off. I really appreciate your help, and I really appreciate that this website is available for support, sugguestions, and ideas to promote online safety. Thanks guys.
