Myspace profile theft

I am posting this on behalf of a friend. He has recently had his Myspace profile stolen by someone he is acquainted with who has taken over and changed his password and the email linked to it. They are now using this profile to post Photoshopped pictures of my friend as well as some of his other friends. While these pictures are fake, their families are not exactly tech savvy, and such pictures could eventually lead to some really bad situations and bitter feelings. While my friend is aware that he can simply send a salute to myspace to get this profile deleted, he is concerned that this person could continue cyberstalking him with threats such as sending said fake pictures to members of his family and his friends' families, or even set up a different Myspace page.

Does anybody know if my friend has any options at this point, or any legal recourse that can be taken against this person? He has tried speaking to the other party in person, but they hold a deep grudge and is simply doing all of this out of malice and meanness. By the way, all parties involved are legal adults.

Thank you in advance for any help anyone can offer.

Hi Maureen, thanks for the reply.

To what extent will a restraining order be effective? As I understand it, a restraining order only protects against physical pain/danger/harassment?

Welcome Purple_Lizard, Has your friend thought about pursuing a restraining order against this person? Most courts have clerks or departments to help filers with the process.
